If you are a customer of a participating restaurant (“Merchant”), we may receive order and loyalty data (e.g., purchase amounts, timestamps, rewards balances) to operate loyalty, CRM, and analytics tools for that Merchant.

Process and fulfill food orders through participating Merchants
Operate loyalty and cash-back reward programs
Send transactional updates (order confirmations, receipts, delivery status)
Send marketing communications where you have opted in
Provide and improve our AI-driven personalization and analytics
Detect, prevent, and investigate fraud or misuse of the Services
Comply with legal obligations
AI and Data Improvement
We may use aggregated, de-identified data to train, test, and improve our algorithms and AI models that power marketing, loyalty, and analytics features.
No personally identifiable information is disclosed in this process.
Sharing and Disclosure

Merchants you transact with, to enable order processing and reward management
Service providers that assist us with hosting, analytics, messaging, customer support, and payments
SMS vendors and carriers for delivery of transactional or marketing texts (no mobile opt-in or consent data is ever sold or shared for marketing purposes)
Legal authorities, if required by law, subpoena, or court order
Business successors, in connection with a merger, acquisition, or sale of assets
We do not sell your personal information.
Loyalty and Cash-Back Data
If you participate in a Merchant’s loyalty or cash-back program via Open:
Reward data (earn amounts, redemptions, expiration dates) is shared only with that Merchant.
Rewards have no cash value and are governed by each Merchant’s terms.
You can view or delete your loyalty profile by emailing support@getopen.com.
SMS and Messaging Data
When you opt in to receive SMS messages:
Message content, phone number, and delivery status may be processed by our messaging partners.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
All categories above exclude text-messaging opt-in data and consent; that information will not be shared with any third parties.
You may opt out anytime by replying STOP to a message or emailing support@getopen.com.
Data Security
We maintain administrative, technical, and physical safeguards—including encryption, secure hosting, and access controls—to protect personal information.
In the event of a data breach involving your data, we will notify affected users and regulators within 72 hours where legally required (e.g., under GDPR).
